At Horizon Fencing & Construction (“we”, “us”, or “our”), we pride ourselves on offering a diverse array of services, meticulously crafted to meet your fencing and construction needs. Fencing: We provide a variety of fencing solutions designed to enhance and secure your residential property. All fencing services will adhere to local laws and regulations to ensure quality and safety.

Patios: Our patio services include design and construction, ensuring a pleasant and functional outdoor space. Any specific rules or guidelines about usage, maintenance, or alterations by clients should be adhered to, ensuring the longevity and aesthetics of the constructed patio.

Block Paving: We offer block paving services for driveways, walkways, and other residential areas, ensuring a blend of functionality and aesthetics. Alterations or damages post-installation may be subjected to additional charges.

General Terms

  • Changes and Adjustments: Any modifications or changes requested post commencement of the project should be communicated and documented in writing to avoid misunderstandings and additional charges

  • Payment: Failure to adhere to the agreed payment terms may result in cessation of services or initiation of penalty charges

  • Access: Clients must ensure reasonable access to the property for the duration of the service provision to avoid delays or disruptions.

  • Client’s Responsibility: Clients must adhere to specific maintenance and usage guidelines provided post-service to prevent undue wear or damage.

  • Service Alterations: We reserve the right to modify or amend the service offerings upon reasonable notice to the client, especially in instances dictated by material availability, weather conditions, or regulatory changes.

  • Limitation of Liability: Our responsibility and liability pertain to the provision of services as agreed and do not extend to indirect or consequential damages arising post-service completion.

Payment Terms

Deposit Requirement: A non-refundable deposit of [specified percentage or amount] is required to secure our fencing and construction services for residential purposes. This ensures the allocation of labour, materials, and other resources necessary to commence the project.

Payment Schedules:

    • Initial Deposit: To commence any project, the agreed deposit must be paid upon signing the contract.

    • Final Payment: The remaining balance will be due upon completion and satisfactory inspection of the project, as per the details specified in the individual contract.

Late Payments: Failure to adhere to the agreed-upon payment schedule may result in project delays or cessation, and may incur late fees. The specifics regarding late fees and impact on project timeline will be clarified in the individual project contract.

Estimates and Quotes: All project estimates and quotes provided prior to contract signing are valid for a defined period. Any variations to the scope of work post-contract may result in adjustments to the final invoice.

Cancellation Policy: In case of project cancellation post deposit payment, the deposit will not be refunded to cover administrative and planning costs incurred by our team. Further terms regarding cancellation will be specified in the individual contract.

Changes and Additions: Any changes to the project after commencement may affect the total cost and expected completion date. All changes must be documented and agreed upon by both parties to ensure clarity and prevent misunderstandings.

 Installation and Delivery

Scheduling: All installations and deliveries shall be scheduled in alignment with client preferences and our operational capacities. We shall mutually agree upon the dates and timings to ensure minimal disruptions.

Delivery: We shall ensure that all products and materials required for the project are delivered in a timely and secure manner. The client is to facilitate a safe and accessible environment for unloading and storage.

Installation: Our qualified team shall undertake installation works adhering to agreed-upon timelines, ensuring quality and compliance with relevant standards and regulations.

Client Obligations: The client is to provide access to the property, and ensure the work area is safe and free from obstructions. Any preparatory work as agreed upon should be completed before the scheduled installation date.

Delays: Any delays in installation and delivery due to unforeseen circumstances (like weather conditions, transport issues, etc.) shall be communicated promptly. We will not bear liability for such delays, but will ensure re-scheduling is negotiated amicably with the client.

Damages: Any damages to products/materials during transit or installation, which are not due to client actions or negligence, will be our responsibility and will be addressed promptly and adequately.

Installation Approval: Upon completion of the installation, the client will be asked to inspect and approve the work. Any discrepancies identified must be reported immediately for rectifications.

Cancellation Policy

Notification Requirement: Clients must provide a written notice of cancellation via email or letter, ensuring it reaches us within the stipulated time frame defined below.

Cancellation Time Frame: Cancellations must be notified at least 7 days before the scheduled start date of the project. Detailed aspects concerning late cancellations are explained below.

Late Cancellation Fee: Should the cancellation occur less than 7 days before the agreed-upon project start date, a late cancellation fee of 25% of the total quoted price will be applicable, to cover costs already incurred.

Deposits: Any deposit paid is non-refundable after 48 hours following the signing of the contract, unless otherwise specified and agreed upon in writing.

Refunds: Any refunds due, subject to the above conditions, will be processed within 5-7 working days from the acknowledgment of the cancellation notice.

Force Majeure: In the event that we or our subcontractors are unable to perform due to unforeseen circumstances beyond anyone’s control, such as extreme weather conditions or national emergencies, neither party will be held liable.

Client Failure: If we are unable to perform our duties due to failures on the part of the client, such as not providing access or failing to prepare the area as agreed, the client may be subject to additional charges.

Company Initiated Cancellations: Should we need to cancel an agreed-upon contract due to internal or unforeseen issues, clients will be notified at the earliest opportunity and any deposits paid will be refunded in full.

Alternative Arrangements: In the scenario that we cannot fulfil our obligation, we shall endeavour to provide an alternative contractor or reschedule to the next available slot, subject to client approval.

 Customer Duties

Access and Site Preparation: Customers are responsible for providing clear access to the project site and ensuring the area is ready for work, free from obstructions and hazardous materials.

Timely Communication: Respond promptly to any communication from our team to ensure the smooth progress of the project.

Payment: Abide by the payment schedule as agreed in the contract, ensuring all payments are made promptly on the agreed dates.

Safety: Ensure that the work site remains safe and accessible for our team throughout the project duration, providing any necessary safety information about the site.

Changes and Additions: All requests for changes or additions to the agreed-upon work scope should be communicated in writing, with adjustments to cost and schedule being agreed upon before implementation.

Permits and Approval: Obtain all necessary permits and approvals for the work, unless otherwise agreed in the contract.

Disputes: In the case of disputes, communicate first with our team to resolve issues amicably and consider mediation before resorting to legal action.

Final Inspection: Participate in a final inspection of the work upon completion and communicate any concerns or issues promptly and in writing.

Feedback: Provide feedback on the completion of the project and, if satisfied, allow us to showcase the work in our portfolio.

Warranty and Guarantee

Standard Warranty: All fencing and construction work is guaranteed to be free from defects in workmanship for a period of 6 months from the date of completion.

Materials Guarantee: We assure that all materials used in the construction will be as specified in the contract and free from defects for a period of 6 months.

Exclusions: The warranty does not cover damage or defects resulting from accidents, misuse, unauthorized alterations, or wear and tear due to natural weathering.

Claim Process: To initiate a claim under this warranty, customers must notify us in writing within 7 days of noticing a defect, providing detailed information about the issue and including photographic evidence where possible.

Repair and Replacement: Upon validation of the claim, we will repair or replace the defective part of the work at our discretion, aiming to commence corrective actions within 30 working days of claim approval.

Transferability: The warranty is non-transferable and applies only to the original purchaser of the work.

No Additional Warranties: No warranty is provided on any materials provided by the customer or any work not performed by our company.

Limitation of Liability: Our liability under this warranty is limited to the repair or replacement of defective work and does not cover any incidental or consequential damages.

Governing Law: The warranty is governed by and construed in accordance with the laws of the United Kingdom.

Disputes: Any disputes arising under this warranty shall be addressed through mediation before resorting to legal proceedings.
